1. Introduction and Overview
At pcachary.in/, operated by Purna Chandra Achary (Branch Suvidha Code: WB 093), we strive to provide the highest quality of professional services, including GST registration, return filing, bookkeeping, and various Government-to-Customer (G2C) services. We understand that circumstances may change; however, because our services involve professional labor, government fees, and digital processing, we have established this Refund and Cancellation Policy to clearly outline the rights and obligations of both the service provider and the client.
By procuring any service through our website or physical center in Budge Budge, Kolkata, you (the “Client”) agree to be bound by the terms of this policy.
2. General Principles of Our Refund Policy
Unlike physical goods, professional financial and legal services are “performance-based.” Once a professional starts working on your file, time and resources are consumed.
2.1 Professional Effort
Our services are executed by a backend team of over 170+ knowledgeable members and experienced relationship managers. A significant portion of the service fee covers the intellectual labor and administrative costs incurred immediately upon the initiation of a service request.
2.2 Third-Party and Government Fees
Many services provided at the GST Suvidha Center involve the payment of government fees (e.g., MCA filing fees, GST penalties, Stamp Duty, Passport fees). Government fees are strictly non-refundable once the payment has been processed on the respective government portal.
3. Service-Specific Refund Conditions
3.1 GST and Taxation Services (Registration, Returns, Audits)
- Before Processing: If a client requests a refund within 24 hours of payment and before any documents have been uploaded or processed by our experts, a refund may be granted minus a 20% administrative handling fee.
- After Processing: Once the application has been drafted or submitted to the GST portal/department, no refunds will be issued.
- Rejections: If a GST registration or amendment is rejected by the department due to “Clarification Required” or “Incomplete Documentation” provided by the client, no refund will be issued. We will, however, assist in re-filing or replying to the notice as per the specific service agreement.
3.2 Company Registration and Compliance (Pvt Ltd, LLP, NGO)
- Name Approval (RUN/Spice+): Fees paid for name reservation are non-refundable as these are paid directly to the Ministry of Corporate Affairs (MCA).
- Digital Signatures (DSC): Once the DSC application is processed and the video verification link is sent, no refund is possible as the license cost is incurred by the Certifying Authority.
3.3 Banking, Loans, and Insurance Services
- Consultancy Fees: Any processing or consultancy fee charged by pcachary.in/ for loan assistance (Mudra Loan, Business Loan, etc.) is for the "service of facilitation." We do not guarantee loan approval, as that is at the sole discretion of the lending bank. No refunds are issued based on loan rejection.
- Insurance: Cancellation of insurance policies is governed by the specific Insurance Company’s (IRDAI) guidelines. We act as a facilitator and will assist you in the cancellation process, but the refund amount is determined by the insurer.
3.4 Government-to-Customer (G2C) Services
Services such as Passport applications, PAN Card correction, Voter ID, and Ration Card involve immediate data entry and appointment booking.
- Once an appointment is booked or the application is submitted to the government server, no refund is possible.
4. Refund Eligibility Criteria
A refund may be considered only under the following specific circumstances:
- Duplicate Payment: If the client is charged twice for the same service due to a technical glitch.
- Service Non-Delivery: If we fail to initiate the service within 7 working days of receiving all required documents and payments from the client.
- Incorrect Service: If the service delivered is fundamentally different from the service purchased (e.g., client paid for ITR-3 but ITR-1 was filed erroneously).
5. Non-Refundable Situations
No refund will be provided in the following scenarios:
- Change of Mind: The client decides they no longer want the business, GST number, or service after the work has started.
- Delayed Documentation: The client fails to provide the necessary documents (e.g., Aadhaar, PAN, Electricity Bill) required to complete the task.
- Departmental Delays: Delays caused by government server downtime, strikes, or slow processing by government officers.
- Inaccurate Information: If the client provides false or misleading information that leads to a rejection of the application.
6. The Refund Process
If you believe you are eligible for a refund based on Section 4, please follow these steps:
- Email Submission: Send a formal refund request to connect@pcachary.in.
- Required Details: Include your Order ID, Branch Suvidha Code (WB 093), payment receipt, and a detailed reason for the refund.
- Verification: Our billing department and your Relationship Manager will review the progress of your file. This process typically takes 5–7 working days.
- Approval/Rejection: You will be notified of the decision via email.
- Credit: If approved, the refund (minus applicable taxes and admin fees) will be processed back to the original payment method within 10–15 working days.
7. Cancellation Policy
- Standard Cancellation: Clients can cancel a service request within 12 hours of payment if the documentation process has not started.
- Subscription/Package Cancellation: For yearly GST filing packages, if a client wishes to cancel mid-year, we will charge for the months already served at the “standard monthly rate,” and the remaining balance will be credited to the client’s wallet for future services. No cash refunds are provided for mid-term package cancellations.
8. Force Majeure
pcachary.in/ shall not be liable for any failure to perform its obligations where such failure results from any cause beyond our reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation (including “line-noise” interference), acts of God, or changes in government tax laws (GST law amendments).
